These terms apply when you use xonicwave.com, including our forms, free guides and other content. By using the site, you agree to them. If you don't agree, please don't use the site.

1. Who we are

The site is operated by Xonicwave, Inc. ("Xonicwave," "we," "us"), a Delaware corporation headquartered at 3111 Camino Del Rio N #400, San Diego, CA 92108.

2. The site is for business use

Our site and services are designed for businesses and other organizations. You must be at least 18 years old to use our forms. If you use the site on behalf of a company, you confirm you're authorized to do so.

3. Our services are governed by a separate agreement

Nothing on this site is an offer to provide services on specific terms. Plan descriptions, prices "starting at" a figure, response targets and similar information are general summaries. Managed IT and cybersecurity services are provided only under a signed Order Form and Managed Services Agreement, which control if they differ from anything on this site.

4. General information, not professional advice

Our articles, checklists, guides, videos and quizzes are general information to help business owners make better decisions. They are not legal, tax, compliance or insurance advice, and they are not a substitute for an assessment of your own systems. Statistics come from the third-party sources we cite and may change after publication.

5. Free offers, guides and referrals

Our Free IT Bill Review and Free Network Assessment are covered by our Free Offer Terms. The Refer & Earn program is covered by the Refer & Earn Program Terms. Free guides are for your own business use; please don't resell or republish them, though you're welcome to share the link.

6. Our content and trademarks

The site and its content, including text, graphics, logos, photos and guides, belong to Xonicwave or our licensors and are protected by copyright and trademark law. "Xonicwave" and "Secure Tomorrow" and our logo are our trademarks. You may view and print pages for your own business use. Other uses need our written permission.

7. Acceptable use

When using the site, you agree not to:

• submit false information or someone else's details without permission;
• upload files that contain malware or that you don't have the right to share;
• try to gain unauthorized access to the site, our systems or other users' data, or interfere with how the site works (security researchers: see our Security page);
• scrape, copy or harvest content or contact details in bulk, or use the site to send spam;
• break any law.

8. What you send us

You're responsible for the information and files you submit. By submitting them, you allow us to use them to respond to you and as described in our Privacy Policy. If you send us feedback or ideas, we may use them without any obligation to you.

9. Third-party links and tools

The site links to and uses tools from other companies, such as Calendly for scheduling and Google for reviews and maps. We're not responsible for their content, policies or availability, and your use of them is governed by their terms.

10. Disclaimers

The site and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the site will be uninterrupted, error-free or free of harmful components.

11. Limitation of liability

To the fullest extent the law allows, Xonicwave will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site. Our total liability for any claim related to the site is limited to $100. This section does not limit liability that cannot be limited by law, and it does not change any signed service agreement.

12. Indemnity

If you misuse the site or break these terms, you agree to cover the reasonable losses and costs, including attorneys' fees, that Xonicwave suffers as a result.

13. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute about the site will be heard in the state or federal courts located in Orange County, California, and you agree to their jurisdiction.

14. Changes to these terms

We may update these terms. The "Last updated" date shows when they last changed. Continuing to use the site after a change means you accept the updated terms. If any part of these terms can't be enforced, the rest still applies.
